1. Agreement to Terms
By accessing or using BarristerAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by an individual Australian barrister ("we", "us", or "our"). If you do not agree to these Terms, you must not use the Service.
2. Description of the Service
BarristerAI is a legal research platform that provides AI-generated headnotes, extracted legal principles, and case analysis for Australian court decisions. Case data is sourced from the Australasian Legal Information Institute (AustLII), a publicly available and free resource. AI-powered analysis is generated using Anthropic's Claude language model.
3. AI-Generated Content Disclaimer
Please read this section carefully.
- Headnotes, legal principles, case summaries, and other analytical content on the Service are generated by artificial intelligence and have not been reviewed or verified by a qualified legal practitioner.
- AI-generated content must not be relied upon as a substitute for reading the actual judgment. You should always refer to the original source material.
- The Service provides no warranty as to the accuracy, completeness, or currency of any AI-generated content.
- The Service does not constitute legal advice. Nothing on the Service creates a solicitor-client or barrister-client relationship.
- You are solely responsible for verifying any AI-generated content before relying on it in any professional, academic, or personal capacity.
4. User Accounts
To access certain features, you must register for an account. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your account credentials and not share them with third parties.
- Notify us promptly of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
5. Subscription and Payment
The Service offers a free tier with limited functionality and a paid subscription at $20 per month (AUD). Paid subscriptions are processed through Stripe. By subscribing, you agree to:
- Pay the applicable subscription fee on a recurring monthly basis.
- Stripe's terms of service governing payment processing.
- Automatic renewal unless cancelled before the next billing cycle. You may cancel your subscription at any time through your account settings.
Refunds are handled on a case-by-case basis at our discretion.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorised access to any part of the Service or its systems.
- Scrape, crawl, or use automated tools to extract data from the Service without written permission.
- Reproduce, redistribute, or commercially exploit AI-generated content from the Service except for your own professional use.
- Interfere with or disrupt the integrity or performance of the Service.
7. Intellectual Property
The Service's software, design, and branding are owned by us or licensed to us. Case law sourced from AustLII is publicly available and subject to AustLII's own terms of use.
AI-generated content (headnotes, principles, and summaries) is provided for your personal and professional use. You may use this content in your legal practice, but you may not systematically reproduce or redistribute it as a competing service.
8. Limitation of Liability
To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
- We are not liable for any loss or damage arising from your use of, or reliance on, AI-generated content, including but not limited to any inaccuracy, omission, or misstatement.
- Our total liability to you for any claim arising from or related to the Service is limited to the amount you have paid to us in the twelve months preceding the claim, or $100 AUD, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian law.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers and limitations of liability) will survive.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.
